These Terms of Service apply to the use of the BesaFit App ("App"), provided by the BesaFit Team, Kreuzlingen, Switzerland ("we", "us").
By registering or using the App, you accept these Terms.
2. Service Description
BesaFit is a fitness and nutrition app that offers the following features:
• Tracking of workouts and training progress
• Recording of meals and calories
• Weight history and body data
• Integration with Apple HealthKit
• Personalized recommendations
The App serves exclusively for information and tracking purposes.
3. Registration and Account
3.1 Requirements
• Minimum age: 16 years (or 13 years with parental consent)
• Valid email address
• Acceptance of these Terms and the Privacy Policy
3.2 Account Security
You are responsible for:
• Keeping your login credentials confidential
• All activities under your account
• Immediately reporting any unauthorized use
3.3 Accurate Information
You confirm that all information you provide is truthful and current.
4. Usage Rights and Obligations
4.1 Permitted Use
You may use the App for personal, non-commercial purposes.
4.2 Prohibited Use
The following is prohibited:
• Reverse engineering or decompiling the App
• Automated access (bots, scrapers)
• Transferring your account to third parties
• Using for illegal purposes
• Manipulating data or systems
• Distributing harmful content
4.3 Violation
In case of violation of these rules, we may suspend or delete your account.
5. Health Notice / Medical Disclaimer
5.1 No Medical Advice
The App does NOT replace:
• Medical advice or diagnosis
• Professional nutritional counseling
• Medical treatment
5.2 Personal Responsibility
• Consult a doctor before starting any training or nutrition program
• Especially with pre-existing conditions, pregnancy, or medication
• Train within your physical limits
5.3 Liability Disclaimer
We assume no liability for health damages resulting from the use of the App.
6. Intellectual Property
6.1 Copyright
All content of the App (design, text, graphics, code) is protected by copyright and owned by BesaFit.
6.2 Usage License
You receive a limited, non-exclusive, non-transferable license to use the App.
6.3 Your Content
You retain all rights to your own data (workouts, meals, photos).
7. Subscriptions and Payments
7.1 Free Version
The basic version of the App is free to use.
7.2 Premium Subscription (if available)
• Prices are displayed in the App Store
• Billing is processed through Apple
• Automatic renewal unless cancelled
7.3 Cancellation
• Cancel via iPhone Settings > Apple ID > Subscriptions
• At least 24 hours before the end of the current period
7.4 Right of Withdrawal
According to Apple App Store policies, you have a 14-day right of withdrawal. Refunds are processed by Apple.
8. Availability and Changes
8.1 Availability
We strive for high availability but cannot guarantee 100% uptime. Maintenance will be announced when possible.
8.2 Changes to the App
We reserve the right to modify, expand, or discontinue features of the App at any time.
8.3 Changes to Terms
You will be informed of significant changes. Continued use constitutes acceptance.
9. Limitation of Liability
9.1 Liability Disclaimer
To the extent permitted by law, we are not liable for:
• Indirect or consequential damages
• Data loss
• Lost profits
• Damages due to force majeure
9.2 Liability Cap
Our liability is limited to the amount you have paid for the App in the last 12 months.
9.3 Exceptions
These limitations do not apply in cases of intent, gross negligence, or breach of essential contractual obligations.
10. Termination and Account Deletion
10.1 Termination by You
You can delete your account at any time in the App settings.
10.2 Termination by Us
We may suspend or delete your account for violation of these Terms.
10.3 Consequences of Termination
• All your data will be deleted
• An active subscription must be cancelled separately
11. Privacy
The processing of your data is governed by our Privacy Policy.
12. Applicable Law and Jurisdiction
12.1 Applicable Law
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
12.2 Jurisdiction
The place of jurisdiction is Kreuzlingen, Switzerland. For consumers, the mandatory provisions of their country of residence also apply.
13. Severability Clause
If any provision of these Terms is invalid, the validity of the remaining provisions shall not be affected.
